Though each project will look different for each customer, before moving forward with an official commission or large project I request these conditions be agreed upon while discussing details of customized work. For trusted, long-term customers I will work with you on an individual basis for each commissioned piece.

This is the standard form before a contract is made between the Artist and Client. Once the Commission officially begins, a document will be made that will complete the specifications of the form.

ARTWORK COMMISSION AGREEMENT

This Agreement entered on date ________, between Hilary Greenwald (“Artist”) and ________ (“Client”), shall govern the respective rights of Artist and Client with respect to the artwork described.

I. Scope of Work Commissioned

Artist and Client agree that the artwork to be created by Artist to Client’s specifications will be signed by both parties. The following artwork will be referred to as “the Work”:

II. Deadlines and Completion

Upon receipt of Client’s specifications given in Section I, which Client agrees are true and complete at the time of this Agreement, Artist agrees to complete the Work on or before this given date: ___________________

Artist will complete preliminary sketches for the Client. Upon approval from the Client, the Artist then will begin on the final project, checking in with progress every______ days (depending on the scope and deadline of the Work).

III. Rights Transferred

Artist and Client agree that the following rights will be transferred from Artist to Client upon receipt of full payment.

Artist agrees to the license of all rights to Work to Client, excluding only the right to authorship credit, which is retained by Artist. The Artist keeps the rights to display the Work in their portfolio or website. When asked, Client must properly identify Artist as the creator of Work. Any and all rights not specified in this document will be kept by the Artist.

IV. Compensation

The Client will pay Artist a total flat fee of $_________ as total compensation for the project described above. Payment is to be be made as follows:

·   50% at start of work as down payment, covering the cost of materials for the Work.

·   50% within (10) days upon the client receiving the finished Work.

Additional to the flat fee of the work are all sketches, shipping, and packaging of the Work. If so desired by the Client, insurance of the Work would also be added to the final cost.

V. Termination/Kill Fee

Client may terminate this Agreement at any time by sending written notice to Artist at the address provided. Upon termination, Client agrees to compensate Artist as follows:

(1) Partial Completion. If Artist has partially completed the Work, Client agrees to compensate Artist at twenty percent (20%) of the total price of the Work. If this Agreement is terminated by Client after Partial Completion by Artist, Artist shall retain ownership of all rights including the original artwork and all related sketches.

(2) Full Completion. If Artist has completed the finished artwork at the time of cancellation at no fault on part of the Artist, Client agrees to compensate Artist in full.

VI. Liability and Damages

In the event of the Client receiving the Work in a damaged condition or going missing after it has been sent, the Client is to contact the Artist immediately to bring about a resolution as soon as possible.

I, Hilary Greenwald, the Artist, within the best of my intention and ability, agree with the terms of this contract and hereby declare the commencing of this Commission on the date of receiving agreement from the Client.
